Terms and Conditions - Walrus Games

 

Article 1. General

1.1 These general terms and conditions apply to every offer from Walrus Games and to every agreement concluded between Walrus Games and the consumer.

1.2 By placing an order, you indicate that you agree to the delivery and payment conditions. Walrus Games reserves the right to change its delivery and/or payment conditions.

1.3 Unless agreed otherwise in writing, Walrus Games does not recognize the general or specific conditions or provisions of third parties.

 

Article 2. Delivery

2.1 Delivery takes place while stock is available.

2.2 In accordance with the rules of distance selling, Walrus Games will execute orders within 30 days at least, unless another delivery period has been agreed upon. If delivery within 30 days or the agreed upon delivery time is not possible (due to the ordered items being out of stock or no longer available), or if there is a delay for other reasons, the consumer will be informed within 1 month after placing the order. In such cases, the consumer has the right to cancel the order without costs or notice of default.

2.3 Walrus Games reserves the right to refuse an order without stating reasons.

 

Article 3. Prices

3.1 All prices on the site, including shipping costs, are subject to typying errors. No liability is accepted for the consequences of printing and typesetting errors.

3.2 All prices are, unless otherwise indicated, expressed in Euros, including VAT.

 

Article 4. Right of Withdrawal

4.1 The purchaser of products has the right to return the delivered goods within a period of 14 working days without stating a reason. This period starts from the moment the ordered goods have been delivered. The purchaser is obliged to notify Walrus Games in writing of their intention to return the goods within the 14-day period after receipt. If the purchaser has not notified within the 14-day period after receipt that they wish to use the statutory right of withdrawal, the purchase is final.

 

Article 5. Data Management

5.1 If you place an order with Walrus Games, your data will only be used for handling this order.

 

Article 6. Warranty

 

6.1 Walrus Games does not offer a warranty on delivered goods beyond the warranty conditions of the manufacturer of these goods, without prejudice to the rights of the customer arising from mandatory statutory provisions.

6.2 The customer is obliged to check the delivered goods immediately upon receipt. If it appears that the delivered item is incorrect, defective, or incomplete, the customer must notify Walrus Games of these defects immediately in writing, before returning the goods to Walrus Games. Any defects or incorrectly delivered goods must and can be reported to Example Shop in writing up to a maximum of 2 months after delivery. The return of goods must be in the original packaging (including accessories and accompanying documentation) and in new condition. Use after noticing a defect, damage arising after noticing a defect, burdening, and/or resale after noticing a defect, nullifies the right to complain and return.

6.3 If the complaints of the customer are found to be justified by Walrus Games, Example Shop will, at its discretion, either replace the delivered goods free of charge or reach a written agreement with the customer on compensation for damages, provided that Walrus Games' liability and hence the amount of compensation are always limited to at most the invoice amount of the relevant goods, or (at the choice of Walrus Games) to the maximum amount covered by the liability insurance of Walrus Games in the relevant case.
